Mixed Breed · Unknown

It is not a crime to keep a dog in the garage, but it can become one. It is not a crime to keep a dog in the garage, but it can become one if the conditions cause suffering or expose the dog to dangers, such as when the premises are damp, without light or with insufficient lighting, dirty, with limited movement, or with temperatures that are too high or too low. These conditions are mostly defined by judicial rulings (Court of Cassation n. 12436/2021 and n. 537/2023) and, much more rarely, by municipal regulations: and when the situation is really precarious for the dog and puts its very existence at risk or significantly prejudices its physical and psychological well-being, the committed offense will no longer be abandonment, but rather the more serious offense of animal cruelty. Normally, using the garage as a shelter for dogs is more frequent in winter, when people who prevent the dog from entering the house move it from the garden to the garage, leaving it in those rooms at night and sometimes even for the entire day, maybe tied to a rope or a chain. These are often detached spaces from the residence, cold, almost always damp, not infrequently dirty and full of objects and materials, thus entirely unsuitable for housing any animal. Most of the time, people also do not bother to secure the antifreeze for the car, which can be lethal for domestic animals like dogs and cats even in small quantities - for example, following a leak of propylene glycol from the radiator. There are also those who, perhaps to raise the internal temperature of the vehicle before departing, leave the car in the garage with the engine running and do not worry about the presence of a dog or cat for whom carbon monoxide could be fatal. Sometimes, the presence of household animals is so insignificant to the person that, moving the car to leave, they do not check if the dog (maybe small-sized) or the cat has taken refuge under the car to warm up with the heat produced by the engine. And regarding cars - which have very little insulation from external weather conditions - leaving a dog in the car during the cold season could also constitute abandonment and cruelty, because it exposes the dog to the risk of hypothermia, a condition that can become severe for the dog and even lead to freezing, especially if the duration of stay is not brief, if there is no sunlight or the temperature is particularly low. And blankets and coats are only helpful for a few minutes...
