Un disegno di legge per tutelare al meglio gli animali

The bill n.1078, which introduces some significant changes to the legislation on animal protection, was assigned to the Senate Justice Committee on May 8th. The initiative is from the Five Star Movement and the Five Star Ministers of Health, Justice and Environment. It's certainly not a coincidence that the initiative comes just before the vote for the European Parliament, but the hope of the entire animal protection world is that the approval can arrive in reasonable time: the introduction of stricter rules to protect animals is contained in the famous government contract, but it is equally certain that the opposition of Lega - always very sensitive to the hunting world - will not be delayed. Many positive things are included in the bill. First of all, crimes committed against animals are moved from the sphere of man to that of animals: it would really be a "Copernican revolution", as the first signatory Perilli said, because "from the feeling for animals that today protects the feeling of compassion of the person for animal suffering, we move to a protection of animals 'for the rights that they intrinsically have'. In practice, the animal would change its legal position: from an object it would become a protected subject, deserving the establishment of a specific section regarding animal crimes in the police forces database. Significant is the harshening of punishments: for the crime of abandonment, the penalty goes from 1 to 3 years, for killing from 2 to 5 years, for animal abuse from 3 months to 3 years and for illegal shows from 6 months to 5 years. Leaving poisoned meat around finally becomes a crime, punishable by arrest up to 4 years, and killing protected species also becomes a crime. An aggravating factor is provided in case of theft of a domestic animal. Finally, police officers and agents can arrest anyone caught in the act of committing a crime. The harshening of penalties also affects poaching and violations of the hunting silence, while article 12 of the bill provides for the abolition of article 842 of the civil code, which currently allows hunters to enter non-fenced lands: and it is obvious that Lega's opposition will start here!

L'8 maggio scorso è stato assegnato alla Commissione giustizia del Senato il disegno di legge n.1078 che introduce alcune significative modifiche alla normativa in materia di tutela degli animali. L'iniziativa è del Movimento 5 Stelle e dei ministri pentastellati della Salute, della Giustizia e dell'Ambiente. Certo non è un caso che l'iniziativa cada proprio a ridosso del voto per il parlamento europeo, ma la speranza di tutto il mondo animalista è che l'approvazione possa arrivare in tempi ragionevoli: l'introduzione di norme più stringenti per tutelare gli animali è, infatti, contenuta nel famoso contratto di governo, ma è altrettanto sicuro che l'opposizione della Lega – da sempre sensibilissima al mondo venatorio – non si farà attendere. Molte le cose positive contenute nel disegno di legge. Innanzittuto, i reati commessi in danno agli animali vengono spostati dalla sfera dell’uomo a quella degli animali: sarebbe davvero una “rivoluzione copernicana”, come ha detto il primo firmatario Perilli, poiché “dal sentimento per gli animali che oggi tutela il sentimento di pietà della persona per la sofferenza animale, si passa ad una tutela degli animali “per i diritti che intrinsecamente hanno”. In pratica, l’animale cambierebbe posizione giuridica: da oggetto diventerebbe soggetto tutelato , tanto da meritare l'istituizione di un'apposita sezione riguardante i reati sugli animali nella banca dati delle Forze di polizia. Significativo l'inasprimento delle sanzioni: per il delitto di abbandono la pena passa da 1 a 3 anni, per l'uccisione da 2 a 5 anni di reclusione, per il maltrattamento di animali da 3 mesi a 3 anni e per le manifestazioni illegali da 6 mesi a 5 anni. Lasciare in giro bocconi avvelenati diventa finalmente un reato, punito con l'arresto sino a 4 anni e diventa “delitto” anche l’uccisione di specie protette. Un’aggravante è, invece, prevista in caso di furto di animale domestico. Infine, ufficiali e agenti di polizia potranno arrestare chiunque sia colto in flagranza di reato. L’inasprimento delle sanzioni colpisce anche il bracconaggio e le violazioni del silenzio venatorio, mentre l'art.12 del ddl prevede l'abolizione dell'art.842 del c.c. che oggi permette ai cacciatori di entrare nei terreni non recintati: ed è scontato che l'opposizione della Lega partirà da qui!
