On Thursday, March 30, Judge Paolo Velo suspended the trial against Michael Ragazzo (31 years old), accused of having suffocated a dog together with his friend Daniele Porta (48 years old), for whom the hearing was postponed to October 5. Michael Ragazzo was therefore admitted to a probation period of 8 months in the municipality of Belluno, while each of the animal welfare associations that had joined as civil parties was awarded a symbolic sum of 50 euros. The events date back to Friday, April 19, 2019: Kaos - the young pitbull - died of strangulation by some people who pinned the dog to the ground in the parking lot of Super W in Agordo and killed it using the leash. The incident occurred after a conflict between groups of teenagers, during which Kaos, apparently overwhelmed by the situation and the shouts, bit its owner; however, at the time of suffocation, the dangerous situation had ceased and the dog no longer posed any problem, so it is likely that the particularly brutal killing happened only out of cruelty. From the first days after the incident, Apaca has monitored the investigations with the legal assistance of attorney Marinella Pasin, who voluntarily provided her professional services throughout all phases of the proceedings. The judge's admission of our participation as a civil party was the only source of satisfaction in this process, as it meant that the judge recognized that Ragazzo's unlawful conduct (and possibly Porta's, who was judged capable of understanding and willing on the evening of Friday, April 19, 2019 by a psychiatric evaluation) affected not only the living being (the dog) directly protected by the criminal law, but also the ethical and moral heritage that Apaca represents in the defense and protection of animals. However, the likely conclusion of the criminal procedure does not fully satisfy the need for justice that motivated our intervention in the trial. Indeed, the judge considered it appropriate to admit the defendant to a probation measure, applicable for crimes punishable by imprisonment up to six years, alone, combined or alternative to a fine, and for no more than once. According to the website of the Ministry of Justice, with the suspension of the proceedings, the defendant is placed under the external penitentiary execution office to carry out a treatment program that includes as mandatory and free activities, the performance of a public utility work for the community, which in this case will be carried out in the municipality of Belluno. In February 2024 - the date set for the new hearing - the judge will assess the outcome of the probation, and if satisfactory, will declare the extinction of the crime and the end of the process, without issuing any conviction sentence. In reality, it is not a "duty act," because the judge's discretion is broad both in the admission phase and in the execution and final assessment of the probation. Precisely for this reason, the need for justice that we feel compelled to publicly express - which has nothing to do with judicialism - imposes on us to hope not only that the treatment program is strictly followed, but that the public utility work in the municipality of Belluno truly demonstrates to be useful for the rehabilitation of a person accused of intentionally causing the rupture of the trachea and the subsequent death of a living being who - exactly like a human animal - was a carrier of the right to life. Giovedi 30 marzo, il giudice Paolo Velo ha sospeso il processo nei confronti di Michael Ragazzo (31 anni), accusato di aver ucciso un cane per soffocamento insieme all'amico Daniele Porta (48 anni), per il quale c'è stato un rinvio dell'udienza al 5 ottobre. Michael Ragazzo è stato, infatti, ammesso alla messa alla prova per un periodo di 8 mesi presso il comune di Belluno, mentre a ciascuna delle associazioni animaliste che si erano costituite parte civile è stata riconosciuta una cifra simbolica di 50 euro. Uno dei fotogrammi dell'uccisione di Kaos pubblicati dalla stampa locale nel 2019 I fatti risalgono a venerdi 19 aprile 2019 : Kaos – così si chiamava il giovane pitbull – muore per strangolamento ad opera di alcune persone che nel parcheggio del Super W di Agordo bloccano a terra il cane e, usando il guinzaglio, lo uccidono. Il fatto avviene dopo una lite tra gruppi di ragazzi, nel corso della quale Kaos, evidentemente sopraffatto dalla situazione e dalle grida, morde il suo proprietario: ma al momento del soffocamento la situazione di pericolo era cessata e il cane non dava più alcun problema, per cui è verosimile che l'uccisione, particolarmente brutale, sia avvenuta solo per crudeltà. Fin dai primi giorni dopo l'accaduto, Apaca ha monitorato le indagini grazie all'assistenza legale dell'avv. Marinella Pasin, che ha prestato gratuitamente la propria opera professionale in tutte le fasi del procedimento. L'ammissione da parte del giudice della nostra costituzione di parte civile è stata l'unico motivo di soddisfazione in questo processo, dato che, in questo modo, il giudice ha riconosciuto che la condotta illecita di Ragazzo (e probabilmente di Porta, che la perizia psichiatrica ha giudicato capace di intendere e volere la sera di venerdi 19 aprile 2019) ha inciso non solo sull'essere vivente (il cane) tutelato in via diretta dalla norma penale, ma anche sul patrimonio etico e morale di cui Apaca è portatrice nella difesa e tutela degli animali. E', però, la conclusione probabile del procedimento penale a non soddisfare pienamente l'esigenza di giustizia che ha animato il nostro intervento nel processo. Il giudice, infatti, ha ritenuto di ammettere l'imputato alla misura della messa alla prova, concedibile per reati puniti con la reclusione fino a sei anni, sola, congiunta o alternativa alla pena pecuniaria e per non più di una sola volta. Come si legge sul sito del Ministero della Giustizia, con la sospensione del procedimento, l'imputato viene affidato all'ufficio di esecuzione penale esterna per lo svolgimento di un programma di trattamento che prevede come attività obbligatoria e gratuita, l’esecuzione di un lavoro di pubblica utilità in favore della collettività, che, nel caso di specie, sarà svolto presso il Comune di Belluno. Nel febbraio del 2024 – data fissata per la nuova udienza – il giudice valuterà l'esito della messa alla prova e, se sarà soddisfacente, dichiarerà l'estinzione del reato e la relativa conclusione del processo, senza emettere alcuna sentenza di condanna. In realtà, non si tratta di “atto dovuto”, perchè la discrezionalità del giudice è ampia sia nella fase di ammissione, sia in quella dello svolgimento e della valutazione finale della messa alla prova. Proprio per questo, l'esigenza di giustizia che ci sentiamo di manifestare pubblicamente – e che non ha nulla a che vedere con il giustizialismo – ci impone di auspicare non solo che il programma di trattamento sia puntualmente rispettato, ma che il lavoro di pubblica utilità presso il comune di Belluno dimostri davvero di essere utile alla riabilitazione di una persona imputata di aver volontariamente provocato la rottura della trachea e la conseguente morte di un essere vivente che – esattamente come l'animale umano – era portatore del diritto alla vita.
